Attorney General and Minister of Legal Affairs Anil Nandlall, SC, has rejected claims that the recent promotions within the Guyana Police Force (GPF), as recommended by the Police Service Commission (PSC), are unlawful.



 



 



He described these assertions as baseless and rooted in ignorance. Nandlall clarified that those questioning the legality of the promotions are misinterpreting a ruling made two years ago by Acting Chief Justice Roxane George.



In that case, Opposition Leader Aubrey Norton challenged the legitimacy of the PSC at the time on the grounds that it was not properly constituted due to the absence of a chairman.



The Chief Justice ruled in favour of that argument, stating that a commission cannot be lawfully constituted if a key member is missing from the outset. However, Nandlall argued that the current situation is different.



“Those who are saying that the commission is not properly constituted now are saying that because a member passed away, the entire commission is unlawful. That is not the ruling of the Chief Justice,” he asserted.



He explained that the PSC was fully constituted when it was sworn in, and the death of a member merely created a vacancy, which does not invalidate the commission’s authority.



He added that the Constitution explicitly states that the PSC can continue to perform its functions despite such a vacancy.



Moreover, Nandlall took a jab at non-legal commentators who, according to him, are misinforming the public about legal matters.



“These subtle principles are lost on those who want to shape public opinion but have no legal competence. To draw attention to themselves, they make bold claims that have no legal basis,” he said.



He further urged journalists and members of the public to refer directly to the Chief Justice’s ruling or seek legal guidance rather than rely on uninformed opinions circulating on social media.
